NEVER give a collection agency direct access to your bank account. It is very common for them to take duplicate or take more or take it early. Unfortunately for you, you have no written record of the agreement for them to take the payment on the 4th or that you called on the 1st to stop the payment.

Stop talking to these people on the phone. They are not going to have you arrested. That is a scare tactic. Send them a certified, return receipt letter indicating that due to their error in drafting your bank account before the agreed date, you want all future communications in writing.

If you are already signed up for credit counseling with Debt Solutions, let them deal with the collector to work out a payment arrangement.

In the future, remember to always get a written settlement agreement before you pay and never give them direct access to your bank account. Had they actually taken you to court, the worse thing that would happen is they would win a judgment and garnish your pay but the max they could take would be 25%.

I dont think you can go to jail for ONE bounced check. They are overdramatizing it to scare you. The most they can do is report you to the credit bureau...

BUT

You need get documentation from your bank saying that you are a victim of fraud. Or have your bank mail them a certified letter. This could cause an extension in your payment to them.

Your bills do not sympathize with one another. You should have called back asap the first time so that you could offer to make monthly payments in good faith..

Call them again and ask if your bank sends documentation about your banking situation, will they reevaluate your offer of a payment plan.

Will your bank give you a loan? Can you borrow the money from someone or at least half?

If all else fails, seek advice from a lawyer. They even have lawyers that benefit low income people.

Goodluck..

You will not go to jail but you will be arrested. You owed a debt and failed to pay nor did you make any arrangements when you first ran into trouble. You ignored the problem until it grew. Once this goes to court your debt will be in the thousands. Try and set up some payment plan.

First of all, if you bounce a check (which I am not sure this qualifies as that since it was supposed to be a debit), they can take this info to the prosecutors office and the prosecutors office will put out a warrant for you. Debt collectors will scare you in any way possible to get you to pay the debt. Most likely, they would not have filed a lawsuit against you. They would have to file the lawsuit in the county that YOU live in, most of the time it is not worth their time or money. But we are past that point now. I have set up payments with companies before and turned out to not have the money and it was never considered the same as a bounced check. Secondly, they cannot record you unless you gave them permission to record you. If they did this without your permission then it is illegal. I would call your state's attorney generals office and speak to someone explaining your situation and tell them that you are being harrassed by this collection agency. I have spoken with mine and they were very helpful. Debt collectors are the lowest scum on this planet and do not care about your personal situation. I would switch banks as well, they should be a lot more helpful then it appears they have been. Good luck and I hope everything works out.
